Report

Consumer Protection Regime in India

Consumer protection in India has dual dimensions. It first has to ensure availability and access to basic needs of life to one section of the society; on the other hand, those with the purchasing power need to be protected against violation of their other rights.

The report will serve as a platform:

  • to identify the prevailing gap between the ideal and actual situation in the countries on individual basis and attempt to fill in that gap by following good practices of a well developed Consumer Protection Regime;

  • for comparative analysis between developed, developing and under-developed countries on their approaches to Protection of Consumers; and

  • for strengthening the knowledge base of the civil society organisations, governments, intergovernmental organisations and other stakeholders by providing a ready reckoner in the form of a comprehensive report


The State of the Indian Consumer

The study has surveyed and analysed the existing legal provisions and policies of the Government in ensuring the eight consumer rights that have been derived from the UN Guidelines on Consumer Protection and included in the Consumer Charter adopted by Consumers International. In terms of legal provisions and policies of the Government, the study finds that India’s achievement is quite good. However, when it comes to implementation, India scores quite low. The study recommends an integrated National Consumer Policy for the country and also suggests some measures to improve the situation especially on implementation issues.


Viewpoint Paper

Consumer Protection, Competition, Competitiveness and Development

This viewpoint paper examines the role of consumer protection and competition policies in promoting development, and in enhancing and maintaining competitiveness in an economy. It also analyses the convergence of objectives of consumer protection policy and competition policy in the context of consumer welfare. Argues that competition policy is an essential element to instil competitiveness in the economy and promote economic development.
